1. Agreement to Terms

By accessing or using wheneu (“the Platform”), including our website and any associated services, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Platform.

2. Age Requirement

You must be at least 18 years old to use this Platform. By using the Platform, you represent and warrant that you are 18 years of age or older.

3. What wheneu is

wheneu is a marketplace connecting venue owners with customers looking to book event spaces across Kerala. We act as an intermediary, facilitating:

  • Venue discovery and browsing
  • Booking reservations and scheduling
  • Advance payment collection and tracking
  • Real-time notifications for booking updates
  • Venue management dashboards for owners
  • Analytics and reporting tools

The service is provided “as is” without warranties of any kind.

4. Bookings

A booking is considered confirmed only upon receipt of the advance payment. Customers are responsible for the remaining balance directly to the venue owner on or before the event date. wheneu facilitates the advance payment but does not process or hold the remaining balance.

5. User Accounts

  • You are responsible for maintaining the security of your account credentials.
  • You must provide accurate and complete information when creating an account.
  • You are responsible for all activity that occurs under your account.
  • Notify us immediately of any unauthorized access to your account.
  • Each person may only maintain one account unless explicitly authorized.

6. Venue Owner Responsibilities

Venue owners are fully responsible for ensuring the venue matches its description and provides the amenities listed. They must maintain a valid subscription to remain active on the platform. Venue owners agree to:

  • Provide accurate venue details, photos, and pricing
  • Honor confirmed bookings at the listed terms
  • Maintain their calendar and availability in real-time
  • Respond to customer enquiries in a timely manner

7. Acceptable Use

You agree NOT to:

  • Use the Platform for any illegal purpose
  • Attempt to access other users' data or accounts
  • Interfere with Platform functionality or security
  • Upload malicious, offensive, or infringing content
  • Post fraudulent listings or misleading information
  • Attempt to bypass our payment systems to book venues off-platform
  • Harass, threaten, or abuse other users

8. Subscription & Billing

  • Free Trial: New venue owner accounts may be enrolled in a free trial period.
  • Paid Plans: After the trial, a subscription may be required to continue accessing premium features.
  • Cancellation: You may cancel your subscription at any time. Features will remain active until the end of the billing period.
  • Refunds: Subscription fees are non-refundable except as required by law.

9. User-Generated Content

  • You retain ownership of content you upload (photos, logos, descriptions).
  • You grant wheneu a limited license to display and process this content solely for operating the Platform.
  • You represent that you have the right to use any content you upload.
  • You agree not to upload offensive, illegal, or infringing content.

10. Intellectual Property

All content, features, and functionality of the Platform are owned by wheneu and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any part of the Platform without written permission.

11. Notifications

By using wheneu, you consent to receive notifications regarding your account activity, including booking confirmations, payment reminders, enquiry updates, and system announcements via WhatsApp, email, and push notifications. You can manage these preferences in your account settings.

12. Payment Information

The Platform facilitates advance payments through third-party payment processors (Razorpay). wheneu does not directly process or store full payment credentials. You are responsible for the accuracy of payment records. We are not liable for any financial discrepancies between you and venue owners regarding final settlement amounts.

13. Limitation of Liability

To the maximum extent permitted by law:

  • wheneu is not liable for indirect, incidental, special, or consequential damages.
  • We do not warrant uninterrupted, error-free, or secure service.
  • We are not responsible for the quality, safety, or legality of venues listed on the Platform.
  • Total liability shall not exceed the amount paid by you for the service in the 12 months preceding the claim.

14. Termination

We may suspend or terminate your account if you violate these terms, upon reasonable notice where possible. Upon termination, you may request deletion of your data as described in our Privacy Policy. You may also request account deletion at wheneu.com/delete-account.

15. Dispute Resolution

Any disputes arising from these terms shall be resolved through:

  1. Good faith negotiation between the parties
  2. If unresolved within 30 days, mediation or binding arbitration

You waive the right to participate in class action lawsuits or class-wide arbitration.

16. Governing Law

These terms are governed by the laws of India. Any legal proceedings shall be conducted in the courts of Kerala, India.

17. Changes to Terms

We may update these terms at any time. Continued use after changes constitutes acceptance. We will notify you of material changes via email, WhatsApp, or in-app notification.
